Welcome to AlgoGain (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the AlgoGain mobile application (“App” or “Service”), which offers workout programming for strength, strength endurance, and duration-based fitness routines. By downloading, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the App.
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use AlgoGain. If you are under 18, you may only use the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
By using AlgoGain, you represent that you are in good health and physically able to participate in exercise routines. Always consult a qualified healthcare provider before beginning any new fitness regimen, especially if you have pre-existing medical conditions or injuries.
Currently, no login or account is required to use the App. All workout data, progress tracking, and personal notes (collectively, “User Data”) are stored locally on your device. You are responsible for backing up your device or retaining data if you uninstall or change devices.
During onboarding, you may be offered the option to subscribe to a newsletter, which could include updates, fitness tips, and promotional information. Subscription is voluntary, and you can unsubscribe at any time by following the instructions in the newsletter or contacting us (see Section 15).
We may introduce a mandatory login in future versions of AlgoGain for:
Should a mandatory login become required, we will update these Terms accordingly and notify you of the changes (see Section 11). If you decline to create an account once the login is mandatory, certain features or the entire App may become inaccessible.
You may delete your locally stored data at any time. If a login becomes mandatory in the future, you will have the ability to delete your account and all associated data from our servers (if any) in accordance with our then-current Data Deletion Policy.
AlgoGain is intended for informational and educational purposes only. We are not medical professionals, and the content, workouts, or programs provided by AlgoGain are not a substitute for professional medical advice, diagnosis, or treatment.
Any exercise or dietary changes you choose to make based on the information provided by AlgoGain are done at your own risk. You expressly assume the risk of any and all injury that may result from your participation in any exercise routines or related activities.
We strongly recommend consulting a physician or healthcare professional before making any changes to your fitness routine, diet, or lifestyle.
By using AlgoGain, you agree not to:
We grant you a personal, non-transferable, non-exclusive, revocable, limited license to use the App solely for your personal, non-commercial purposes.
You agree not to copy, distribute, modify, reverse engineer, or otherwise exploit the App except as expressly permitted by these Terms.
All content, features, and functionality in the App—including but not limited to text, graphics, logos, images, video clips, and software code—are the exclusive property of AlgoGain or its licensors and are protected by intellectual property laws. No right, title, or interest in the App or any portion thereof is transferred to you.
AlgoGain Pro is an optional, auto-renewable subscription available through the App Store or Google Play.
Available plans, duration, price, and applicable taxes are shown by the App Store or Google Play before purchase.
Payment, renewal, cancellation, subscription management, and refunds are handled under the applicable store’s terms and settings. Auto-renewing subscriptions continue unless cancelled before the current billing period ends.
The App may contain links to third-party websites, services, or resources that are not owned or controlled by AlgoGain. We do not endorse or assume responsibility for any third-party content or services. Your use of third-party resources is at your own risk and subject to the third party’s terms and conditions.
In the future, if we implement data syncing and analytics features, we may analyze your anonymized workout data to enhance the App’s programs, improve user experience, and conduct fitness research. Any personally identifiable information (if collected) will be handled in accordance with our Privacy Policy.
We take reasonable measures to protect locally stored and (if introduced) server-stored data. However, we cannot guarantee absolute security.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ALGOGAIN, ITS AFFILIATES, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO PHYSICAL INJURY, LOSS OF DATA, LOSS OF PROFIT, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion or limitation of certain liabilities, so the above limitations may not apply to you. In such jurisdictions, AlgoGain’s liability shall be limited to the greatest extent permitted by law.
We may update these Terms from time to time. If we make material changes, we will provide notice within the App or by other means. Your continued use of the App after any such updates signifies your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App.
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict-of-law principles. If you are a consumer habitually residing in the European Union, you may also enjoy the protections afforded to you by the mandatory provisions of the law of your country of residence.
Any dispute arising from or related to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of Munich, Germany, unless otherwise required by law. Claims must be brought on an individual basis, and you waive the right to participate in any class or collective action. Nothing in these Terms affects any statutory rights you may have as a consumer to bring or defend claims in the courts of your country of residence under applicable consumer protection laws.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
These Terms, along with our Privacy Policy, constitute the entire agreement between you and AlgoGain regarding your use of the App and supersede any prior understandings or agreements.

This Section 16 applies only where you download or purchase the App through Apple's App Store.
These Terms are concluded solely between you and AlgoGain, not Apple. AlgoGain, not Apple, is solely responsible for the App and its content. Nothing in these Terms creates usage rules that conflict with the Apple Media Services Terms and Conditions in effect when you agree to these Terms.
For the App obtained through Apple's App Store, the license in Section 5 is a non-transferable license to use the App on Apple-branded products that you own or control, as the Usage Rules in the Apple Media Services Terms and Conditions permit. The App may also be accessed and used by accounts associated with the purchaser through Family Sharing or volume purchasing, where applicable.
AlgoGain alone is responsible for providing maintenance and support for the App as required by these Terms or applicable law. Apple has no obligation to provide any maintenance or support for the App.
AlgoGain alone is responsible for any express warranty or warranty implied by law to the extent it is not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund to you the purchase price paid for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. AlgoGain is solely responsible for any other claims, losses, liabilities, damages, costs, or expenses resulting from a failure to conform to a warranty.
AlgoGain, not Apple, is responsible for addressing any claim by you or a third party relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to meet applicable legal or regulatory requirements, and claims arising under consumer-protection, privacy, or similar laws. Nothing in these Terms limits AlgoGain's liability to you beyond what applicable law permits.
AlgoGain, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your possession and use of it infringes that third party's intellectual-property rights.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with all applicable third-party terms when using the App.
You and AlgoGain acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple has the right, and is deemed to have accepted that right, to enforce these Terms against you as a third-party beneficiary.
By downloading, installing, or using AlgoGain, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.
